We operate in accordance with Indian customs regulations, international shipping laws, and all applicable regulatory frameworks.

3. Definitions

“Services” means all logistics, freight forwarding, customs brokerage, warehousing, transportation, and related services provided by Sarva Services.

“Customer” means any individual, business entity, or organization that engages our services.

“Cargo” or “Goods” means any merchandise, products, or items entrusted to us for transportation, storage, or related services.

“Consignee” means the person or entity to whom cargo is to be delivered.

“Consignor” or “Shipper” means the person or entity shipping the cargo.

“Force Majeure” means events beyond our reasonable control including natural disasters, war, terrorism, strikes, government actions, or pandemics.

4. Service Agreement and Engagement

A binding service agreement is formed when all the following conditions are met:

  • You engage our services through any authorized channel

  • Notify us immediately of any changes or errors
  • Maintain updated contact information

5.2 Documentation

You must provide:

  • All required shipping documents
  • Customs declarations and regulatory paperwork
  • Commercial invoices and packing lists
  • Licenses, permits, and certifications
  • Insurance documentation (if applicable)
  • Any special handling instructions

5.3 Cargo Compliance

You warrant that:

  • Cargo is legally owned and permitted for transport
  • All applicable laws and regulations are complied with
  • Cargo is properly described and declared
  • Prohibited or restricted goods are not included unless declared
  • Cargo is properly packed and labeled
  • All customs duties and taxes will be paid

5.4 Packaging and Labeling

You are responsible for:

  • Proper packaging suitable for transportation mode
  • Adequate protection against damage
  • Correct labeling and marking
  • Compliance with dangerous goods regulations (if applicable)
  • Special packaging for sensitive or fragile items

6. Our Services and Limitations

6.1 Standard of Care

We will:

  • Perform services with reasonable care and skill
  • Act as your agent in customs and logistics matters
  • Use commercially reasonable efforts to meet timelines
  • Maintain professional standards in service delivery

6.2 Service Limitations

We are not liable for:

  • Delays caused by customs, regulatory authorities, or carriers
  • Force majeure events beyond our control
  • Incorrect or incomplete information provided by you
  • Inherent vice or nature of goods
  • Acts or omissions of third-party service providers
  • Strikes, lockouts, or labor disputes
  • Weather conditions or natural disasters

6.3 Third-Party Services

We may engage:

  • Shipping lines and airlines
  • Trucking and transportation companies
  • Warehouse operators
  • Customs authorities
  • Port and terminal operators
  • Insurance providers

When using third-party services, we act as your agent, and those parties’ terms and conditions also apply.

7. Pricing, Payments, and Charges

  • Quotations are valid for the period specified
  • Rates are subject to change based on market conditions
  • Quotations exclude charges not specifically mentioned
  • Final charges may vary based on actual cargo details

7.2 Payment Terms

  • Outstanding amounts from previous transactions

8. Liability and Insurance

8.1 Limitation of Liability

Our liability is limited to:

  • The amount mutually agreed to by both parties prior to initiating service. In the absence of such an agreement, a reasonable amount will be determined by Sarva Services.
  • Exclusion of indirect, consequential, or punitive damages
  • Exclusion of loss of profits, business, or opportunities

8.2 Customs Broker Liability

As a licensed customs broker, our liability for customs-related services is governed by:

  • Customs Brokers Licensing Regulations (CBLR)
  • Indian Customs Act and regulations
  • Professional indemnity coverage limits

8.3 Carrier Limitations

When acting as a freight forwarder, carrier liability limitations apply:

  • Air Cargo: Montreal Convention limits
  • Sea Cargo: Hague-Visby Rules or similar conventions
  • Land Transport: Indian Carriage of Goods Act provisions

8.4 Insurance

  • Cargo insurance is optional and available at additional cost
  • We recommend comprehensive cargo insurance
  • Insurance must be arranged before shipment
  • Claims are subject to insurance policy terms
  • We can facilitate insurance but are not insurers

8.5 Claims Procedure

To make a claim:

  • Notify us in writing within 7 days of delivery/loss
  • Provide detailed documentation and evidence
  • File formal claim within 30 days
  • Cooperate in investigation
  • Claims not filed within time limits are waived

9. Customs Clearance and Compliance

9.1 Customs Broker Services

We provide:

  • Import and export customs clearance
  • Duty and tax calculation
  • Documentation preparation and filing
  • Liaison with customs authorities
  • Post-clearance support

9.2 Customer Responsibilities for Customs

You must:

  • Provide accurate commodity descriptions
  • Declare correct values and quantities
  • Obtain necessary licenses and permits
  • Pay all duties, taxes, and charges promptly
  • Comply with all customs regulations

9.3 Customs Examination and Delays

  • Customs examinations are beyond our control
  • We are not liable for examination-related delays
  • Additional charges for examinations are your responsibility
  • Compliance with customs orders is mandatory

9.4 Prohibited and Restricted Goods

You must not ship:

  • Items prohibited by Indian or international law
  • Restricted goods without proper authorization

10. Dangerous Goods and Special Cargo

10.1 DG Cargo Declaration

For dangerous goods:

  • Full declaration is mandatory
  • IATA/IMDG/ADR compliance required
  • Proper packaging and labeling essential
  • Additional charges apply
  • Special insurance may be required

10.2 Perishable and Temperature-Sensitive Goods

  • Special handling instructions required
  • Additional charges for cold chain services
  • No liability for deterioration beyond our control
  • Proper packaging is customer’s responsibility

10.3 High-Value Cargo

  • Declaration of value is mandatory
  • Additional security measures available
  • Insurance strongly recommended

11. Warehousing and Storage

11.1 Storage Services

  • Storage rates as per agreement or standard rates
  • Goods stored at customer’s risk unless insured
  • We maintain standard duty of care
  • Storage period limits may apply

11.2 Storage Charges

  • Charges calculated on space/weight/duration basis
  • Additional charges for special storage requirements
  • Free storage period (if any) as per agreement
  • Demurrage applies after free period

11.3 Lien and Sale Rights

We reserve the right to:

  • Exercise lien for unpaid storage charges
  • Sell goods after proper notice if charges remain unpaid
  • Recover costs and charges from sale proceeds

12. Force Majeure

We are not liable for failure or delay caused by:

  • Strikes, lockouts, or labor disputes
  • Pandemics or health emergencies
  • Carrier or port disruptions

Performance will be suspended during force majeure, and alternative arrangements will be made when possible.

are owned by or licensed to Sarva Services and protected by intellectual property laws.

We may terminate or suspend services if:

  • Payment obligations are not met
  • Fraudulent or illegal activity is suspected
  • Required by law or regulation
  • Continuing service poses unacceptable risk

15.3 Effect of Termination

Upon termination:

  • All outstanding charges become immediately due
  • Cargo in our possession may be held pending payment
  • You must arrange alternative service providers
  • Confidentiality obligations continue

16. Dispute Resolution

16.1 Negotiation

Disputes should first be resolved through good faith negotiation between authorized representatives.

16.2 Mediation

If negotiation fails, disputes may be referred to mediation before a mutually agreed mediator.

16.3 Arbitration

Unresolved disputes will be settled by arbitration:

  • By a sole arbitrator or panel (as agreed)
